A jury trial ended recently in Fayette County Circuit Court when the defendant, Benyamin Israel of Greenville, requested a directed verdict and it was granted by Judge Don Sheafor.
Israel had been charged in June of 2014 with alleged robbery, aggravated battery/strangling, aggravated battery in a public place and obstruction of justice/destroying evidence.
The request for a directed verdict was made after the state completed its case.
Judge Sheafor noted in the court record the request was made because the defendant did not believe the prosecution had properly identified him as the person committing the crimes and Israel did not feel the state had presented sufficient evidence for a conviction.
Judge Sheafor dismissed all charges for failing to identify the defendant.
Israel represented himself in court with Attorney Patrick Schaufelberger assisting as “standby counsel.”
